Subject: The bar is so low for plaintiffs' lawyers that any colorable claim is ok.

Not that I'm defending them -- I happen to think the "real" ethical line
is much higher than the bar set by the rules of professional
responsibility -- but there's virtually no chance of someone being
sanctioned for making a colorable claim on behalf of his or her
client. In this case it's zealous advocacy run amok but there's a
rationale to it. I agree w G-Len, though, they really need to level with
their clients and additionally explain to them the reputational hit they
may take in the UVA community for following a "scorched earth"
litigation strategy; and I too hope that a no-nonsense judge will look
at this case for what it is and throw it out, assuming they don't have
evidence that we don't know about that shows complicity by the
administration..

Nothing is going to bring their daughter back. The guilty party has
been held accountable. It's time to move on. If you want to try to
clean out the Huguelys, that's one thing. But going after the
university that YL loved is really not a fitting tribute. And going after
first-rate coaches who would never have condoned such behavior
had they known about it is terrible.
