YOu may be right in the long run but I don't think its clear cut. I
don't believe the Va SCt has ever addressed the issue of the duty of a school or school employees to prevent 3P assaults vs. students. At least one other state I am aware of has held there is a heightened duty above the normal 3P assault cases. Give the SCt's relatively recent opinion re: inkeeper's heightened duty to its guests, I think an argument could be made that the student-university relationship is analogous. But we can continue this discussion offline :-) |
